Terms of Use

These Terms of Use ("Terms") are a binding agreement between you ("you", "the Fuxer") and the people who run this Fux'nd server ("we", "us", "the Management"). By creating an account or tapping "I agree", you confirm that you have read these Terms, understood them, and did not just scroll to the bottom. We will know.

1. What Fux'nd is

Fux'nd is a private app for closed groups of friends to share the things they have fucked up ("Fuxes"), rate each other's Fuxes, and crown a Fux of the Month. It is a hobby project run for fun. It is not a company, a bank, a therapist, a court of law or an emergency service.

2. Who may use it

You must be at least 16 years old and invited to a group by a member of that group. You may have one account. Your account is personal: no sharing, no lending, no letting your cousin post on your behalf.

3. The One Retroactive Post Rule

Fux'nd is about fuxes as they happen. A "Retroactive Post" is any Fux about something that happened before you joined the group, including legendary stories from school, the army, weddings, holidays and the year 2009.

  • Each member may make exactly one (1) Retroactive Post, ever, per group.
  • Choose wisely. It cannot be transferred, saved for later in a different group, or exchanged for cash.
  • Any further Retroactive Posts may be called out by the group, rated 1 out of spite, and mocked without limit.
  • In case of doubt about when a Fux happened, the group decides by majority. Their decision is final and unfair.

4. What you may post

  • Your own fuxes only. Do not post other people's fuxes on their behalf. Let them confess themselves.
  • Fuxes must be real. Inventing a fux to win Fux of the Month is itself a fux, and should be reported as one.
  • No illegal content, no nudity, no hate, no harassment, and nothing that seriously hurts someone.
  • Do not post private information, photos or recordings of people who are not in the group without their consent.
  • Do not upload anything you do not have the right to share.

5. Points, badges and Fux of the Month

Points, badges, streaks, tools and titles (including "Fux of the Month") have no monetary value, cannot be sold, transferred or cashed in, and do not entitle you to anything except bragging rights. Ratings are the free and sovereign opinion of your friends. There is no appeals process. Complaints about ratings will be treated as a Fux.

6. Your content

You keep ownership of what you post. You give the members of your group, and us as far as needed to run the app, permission to store and show your content within that group. Content you post is seen by everyone in the group. Screenshots exist; post accordingly. You can ask us to delete your posts or your account at any time.

7. Privacy

We store what you give us: your name, username, password (encrypted, we can't read it), profile photo, posts, photos, audio, ratings and when you were active. It is stored on a private server run by the Management, and used only to run the app. We do not sell it, show ads, or share it with anyone, except that push notifications pass through Apple's or Google's notification services. Backups are kept for up to 30 days.

8. No warranty

Fux'nd is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, uptime, or accuracy of anyone's memory. Things may break, get lost or be rated unfairly.

9. Limitation of liability

To the extent permitted by law, we are not liable for any damages arising from your use of Fux'nd, including but not limited to embarrassment, loss of reputation, loss of dignity, awkward family dinners, ruined friendships, or your boss finding out. You alone are responsible for what you post. You fux'd it, you own it.

10. Suspension and removal

We may remove content or suspend accounts that break these Terms, at our discretion and without warning. Group members may remove you from their group. You may leave at any time.

11. Changes to these Terms

We may update these Terms. When we do, you will be asked to agree again before you can continue. If you do not agree, you may stop using Fux'nd.

12. Disputes

These Terms are governed by the laws of Bosnia and Herzegovina. Before any formal step, all disputes must first be discussed in the group chat over coffee, which, in our experience, resolves everything.
